Eligibility Requirements

To qualify for ILR as an adopted child, the following conditions must be satisfied:

Parental Circumstances: The child must be seeking to stay with adoptive parents who meet one of these criteria:

  • Both parents are present and settled in the UK.
  • One parent is present and settled in the UK and the other parent is deceased.
  • One parent is present and settled in the UK and has sole responsibility for the child’s upbringing.
  • One parent is present and settled in the UK, there are serious family or other considerations, and suitable arrangements for the child’s care are in place.
  • In the case of a de facto adoption, one parent has the right of abode or ILR in the UK and is seeking admission for settlement.
  • Residency Status: The child must have limited leave to enter or remain in the UK.
  • Age Requirement: The child must be under 18.
  • Settlement Status: The child was granted leave to enter or remain under paragraph 315 or 316B with a view to settlement.
  • Life Independence: The child is not leading an independent life, is unmarried, not in a civil partnership, and has not formed an independent family unit.
  • Financial and Accommodation: The child can be adequately accommodated and maintained without public funds in accommodation exclusively owned or occupied by the adoptive parents.
  • Adoption Validity: The adoption must be recognized by UK authorities and have been conducted by the competent authority in the child’s country of origin or residence.
  • Genuine Adoption: The adoption was genuine, involving a real transfer of parental responsibility due to the original parents' or carers' inability to care for the child.
  • Family Ties: The child has broken ties with their family of origin and the adoption was not arranged to facilitate UK residency.
  • General Grounds for Refusal: The application must not fall under general refusal grounds.
