To qualify for British citizenship under this provision of the British Nationality Act 1981, the following
conditions must be met:
1. You were born before 1 July 2006.
2. You would have automatically become a British citizen if your parents had been married at the
time of your birth.
3. You have never previously held British citizenship.
4. The Secretary of State must be satisfied that you are of good character.
This legislation was designed to give individuals who would have automatically acquired British
citizenship before 1 July 2006, had their parents been married, the opportunity to register as British
citizens. Additionally, it allows for the registration of a child who would have had an entitlement under
sections 1(3), 3(1), 3(2), or 3(5) of the British Nationality Act 1981 if the parents had been married
(Section 4F).
You can satisfy the fourth requirement under these conditions:
1- If you were born on or after 1 January 1983 and would have automatically become a British
citizen had your parents been married (section 4G of the British Nationality Act 1981).
2- If you were born before 1 January 1983 and held the status of a UK and Colonies citizen on 31
December 1982 and would have automatically become a British citizen had your parents been
married (section 4H of the British Nationality Act 1981).
3- If you were born before 1 January 1983 and would have become a British citizen on 1 January
1983 due to one of the following reasons:
o You were a British subject before 1 January 1949, and would have automatically become
a citizen of the United Kingdom and Colonies on that date had your parents been
married at your birth.
o You became a citizen of the United Kingdom and Colonies on or after 1 January 1949
and lost that status when a Commonwealth country gained independence, but would
not have if your parents had been married at your birth.
o You never acquired British subject or CUKC status but would have automatically done so
had your parents been married at your birth (Section 4I of the British Nationality Act
1981).
To register as a British citizen under these circumstances, you must provide evidence of your
relationship with your biological father. The Home Office UKVI will accept the following as proof of
paternity if they are genuine and reliable:
1- A birth certificate issued within one year of your birth naming your father.
2- A DNA test report confirming he is your father.
3- A court order that establishes him as your father.
4- Other sufficient evidence demonstrating paternity.
If your parents married after your birth, you might already be a British citizen, depending on the laws governing your father's nationality at the time of their marriage. In some countries, including the UK, the law treats children as if their parents were married at the time of their birth if the parents marry afterward.
