Eligibility for the EUSS Family Permit
Eligibility for the EUSS Family Permit varies depending on your relationship with the individual in the UK.
Here are some scenarios where you might qualify:
As a Family Member of Someone from the EU, Switzerland, Norway, Iceland, or Liechtenstein
You can apply for the permit if your family member began living in the UK by December 31, 2020. This
includes family members who have British citizenship, provided they also hold citizenship from an EU
country, Switzerland, Norway, Iceland, or Liechtenstein, and lived in the UK using their free movement
rights before becoming a British citizen (known as a ‘Lounes’ case). You can also apply if your family
member has dual nationality with an EU country and settled in the UK before July 16, 2012, without
exercising free movement rights (referred to as a ‘McCarthy’ case). If your family member lives outside
the UK but regularly works in the UK, you may also be eligible (known as a ‘frontier worker’).
You may be eligible for an EUSS Family Permit if you previously had a family member from the EU, Switzerland, Norway, Iceland, or Liechtenstein who lived in the UK but has since died, left the UK, or if the family relationship has ended. This is known as having ‘retained the right of residence.’ The family member must have lived in the UK by December 31, 2020. If they moved to the UK after that date, you will typically need a visa to enter the UK.
You can apply for an EUSS Family Permit as a family member of a British citizen if you are currently residing with them in an EU country, Switzerland, Norway, Iceland, or Liechtenstein. You must have been living with them in that country by December 31, 2020. You must apply for the EUSS Family Permit before returning to the UK. This type of application is known as a ‘Surinder Singh’ application.
You can apply for an EUSS Family Permit if you are a family member of an eligible person from Northern Ireland. To qualify, your family member must be an Irish, British, or dual British and Irish citizen born in Northern Ireland. Additionally, when they were born, they must have had a parent who held British, Irish, or dual citizenship, or who had no restrictions on their stay in Northern Ireland.
The EUSS Family Permit is valid for either 4 or 6 months. If your application is approved more than 3 months before your planned arrival in the UK, the permit will be valid for 4 months from your intended arrival date. If approved less than 3 months before your arrival, it will be valid for 6 months from the decision date. During the validity of your EUSS Family Permit, you can enter and exit the UK as many times as you like. It also permits you to work or study in the UK. Before your EUSS Family Permit expires, you should apply for pre-settled status under the EU Settlement Scheme. If approved, you will generally receive pre- settled status, allowing you to remain in the UK for another 5 years. After 5 years of residence in the UK, you can apply for settled status, granting you the right to stay in the UK permanently.
