Who Has an Extended Deadline for Applying for Pre-Settled Status?

Certain individuals are not bound by the June 30, 2021, deadline. This applies if you are: A family member of someone from the EU, Switzerland, Norway, Iceland, or Liechtenstein who was living in the UK by December 31, 2020, and you joined them in the UK on or after April 1, 2021. Applying for a child who was born or adopted in the UK on or after April 1, 2021. A family member of an eligible person from Northern Ireland who could not return to the UK by December 31, 2020, without you, provided you are from outside the EU, Switzerland, Norway, Iceland, or Liechtenstein. Reasonable Grounds' for Missing the Application Deadline

If you did not apply by June 30, 2021, or by the specific deadline applicable to your situation, you may still be able to apply for pre-settled status under the EUSS. To do so, you must have 'reasonable grounds' for missing the deadline. While the list of acceptable reasons is not exhaustive, some examples include:

Being a child or applying for a child and being unaware of the need to apply.

A parent, guardian, or local authority not applying on your behalf as a child.

Having or having had a medical condition that prevented you from applying.

Lacking the physical or mental capacity to apply.

Having care or support needs, or those caring for you were unaware of the deadline.

Being a victim of modern slavery.

Being in an abusive or controlling relationship.

Not having internet access or relevant documents.

Coming to the UK on a work or study visa and becoming eligible for the EUSS while in the UK, but not knowing you could apply.

Already having indefinite leave to enter or remain and not knowing you could apply to the scheme.

Holding permanent residence status or a residence document that became invalid after June 30, 2021, without knowing you needed to apply to the scheme.

Facing difficulties in accessing support due to COVID-19 restrictions.

Any other compelling practical or compassionate reasons that prevented you from applying.

Applying If You Are Exempt From Immigration Control or Cease to Be Exempt

If you are exempt from immigration control, you can continue living in the UK without taking any action.

You will have been informed if you are exempt, such as if you are:

A foreign diplomat posted in the UK.

A member of NATO.

You can apply to the EUSS at any time, provided you or a family member began living in the UK by December 31, 2020. However, your privileges and immunities may change if you obtain settled status. If you cease to be exempt from immigration control, you must apply to the EUSS within 90 days of this change. You will need to demonstrate your exemption status as part of your application. Your family members may also be eligible to apply to the EUSS, regardless of whether they are exempt from immigration control. They can apply at any time, even if you have not yet done so.

When You Should Apply

Joining a Family Member in the UK: If you are entering the UK to join a family member who was already living there, you have 90 days to apply for pre-settled status from the date of your arrival. This applies if you joined them on or after April 1, 2021. If you joined before that date, the deadline was June 30, 2021.

Applying for Your Child: If your child was born or adopted in the UK on or after April 1, 2021, you have 90 days from the birth or adoption date to apply for them. For children born or adopted before that date, the deadline was June 30, 2021.

Family Member of an Eligible Person from Northern Ireland: If you are related to an eligible person from Northern Ireland who could not return to the UK without you by December 31, 2020, you have 90 days from your arrival to apply.

Exempt from Immigration Control: If you are exempt from immigration control, you are not required to apply for pre-settled status, but you can do so at any time. If you lose your exempt status, you will have 90 days to apply.

Limited Leave to Enter or Remain: If your limited leave to enter or remain in the UK expires after June 30, 2021, you must apply before your leave ends.

Family Member of a British Citizen: If you are a family member of a British citizen you lived with in the EU, Switzerland, Norway, Iceland, or Liechtenstein, you must apply by March 29, 2022.

Who is Eligible for Pre-Settled Status?

You must meet one of the following criteria to be eligible for pre-settled status under the EU Settlement Scheme (EUSS):
EU, EEA, or Swiss Nationals: You are from the EU, Switzerland, Norway, Iceland, or Liechtenstein and began living in the UK by December 31, 2020.
Family Members: You are a family member of someone from the EU, Switzerland, Norway, Iceland, or Liechtenstein who started living in the UK by December 31, 2020. Other scenarios where you may be eligible include:
Former Family Members: You were previously related to someone from the EU, Switzerland, Norway, Iceland, or Liechtenstein who lived in the UK before December 31, 2020, but the relationship has since ended due to separation, death, or breakdown.
British Citizen’s Family Member: You are a family member of a British citizen who you lived with in the EU, Switzerland, Norway, Iceland, or Liechtenstein by December 31, 2020, and you returned to the UK with them before applying.
Dual National Family Member: You are a family member of a British citizen who also holds citizenship of an EU country, Switzerland, Norway, Iceland, or Liechtenstein, and they lived in the UK as a citizen of one of these countries before obtaining British citizenship.
Eligible Person of Northern Ireland’s Family Member: You have a family member who qualifies as an eligible person of Northern Ireland.
Child of a Worker: You are the child of an EU, Swiss, Norwegian, Icelandic, or Liechtenstein citizen who used to live and work in the UK, and you are currently in education in the UK.
Exempt Family Member: You are a family member of someone who is exempt from immigration control.
