Eligibility Criteria for BNO Household Member Dependent Visa Entry Clearance
To apply for the BNO household member dependent visa, you need to meet several key requirements as
per the Immigration Rules:
1. Valid Application: You must submit a valid entry clearance application from outside the UK
according to the Immigration Rules set out in the Hong Kong British National (Overseas)
Appendix.
2. Suitability Requirements: Your application must not be refused based on the grounds specified
in Part 9 of the Immigration Rules.
If you are a dependent partner applying for entry clearance and have not previously held permission on
the BN(O) Household Member route, you must satisfy the relationship requirements as outlined in HK
35.3 to HK 35.9:
1- You must be the partner of a sponsoring BNO household member who either has permission on
the BN(O) Household Member route or is applying for and will be granted such permission
simultaneously.
2- Both you and the BNO household member must be 18 years or older at the time of application.
3- If unmarried, you must have lived together in a marriage-like or civil partnership-like
relationship for at least two years before the application date.
4- Any previous relationships must have ended permanently, and you must not be closely related
in a way that would prohibit marriage in the UK.
5- The relationship must be genuine and ongoing.
6- If the BNO household member is a child of a person applying on the BN(O) Status Holder route,
both must belong to the same household on the application date and intend to live together
during the stay in the UK.
If you are applying as a dependent child of a BNO household member, the following criteria must be
met:
1- The sponsoring BNO household member must either have permission on the BN(O) Household
Member route or be applying for and will be granted such permission simultaneously.
2- If neither parent is a BN(O) status holder’s child and you are applying for entry clearance for the
first time, you must belong to the same household as the BNO household member on the
application date.
3- A full UK birth certificate must be provided if you were born in the UK to a BNO household
member or their partner.
If you are applying as a dependent partner or child, you must be ordinarily resident in Hong Kong at the time of your application.
When applying for entry clearance or seeking permission to stay in the UK with less than 12 months of
previous permission, or following a 12-month Leave Outside the Rules after an unsuccessful application
for the Hong Kong British National (Overseas) route, the decision-maker must ensure that the BN(O)
Household Member, their partner, or an individual granted permission on the BN(O) Status Holder route
can adequately maintain and accommodate the applicant in the UK for at least six months without
relying on public funds.
Accommodation will not be considered adequate if it is overcrowded or violates public health
regulations. The BN(O) Household Member, their partner, or an individual with permission on the BN(O)
Status Holder route may depend on credible assurances of future third-party support. However, they
must demonstrate that they have the required funds as specified in Appendix Finance.
Tuberculosis Test Certificate Requirement
Applicants seeking entry clearance as the dependent partner or child of a BN(O) Household Member
must provide a valid medical certificate confirming they have undergone screening for active pulmonary
tuberculosis and that they do not have tuberculosis, in accordance with paragraph A39 and Appendix T
of the Immigration Rules.
A partner who does not already have permission on the BN(O) Household Member route at the time of application will be granted permission ending on the same date as the BN(O) Household Member’s permission. Similarly, a child without prior permission on this route will receive permission aligned with the BN(O) Household Member’s. The visa grant will be subject to the following conditions:
