Requirements for BNO Adult Dependent Relative Visa Entry Clearance

To apply for a BNO Adult Dependent Relative Visa, the applicant must meet the following Immigration Rules:

Valid Entry Clearance Application

The application must be submitted from outside the UK and comply with the valid application requirements outlined in Appendix Hong Kong British National (Overseas) of the Immigration Rules.

Age Requirement

The applicant must be 18 years or older at the time of application.

Relationship Requirement

The applicant must be the parent, grandparent, sibling, or child of a person who is simultaneously applying for entry clearance or permission to stay as:

  • A BN(O) Status Holder applying on the BN(O) Status Holder route, or
  • The partner of a BN(O) Status Holder on the BN(O) Status Holder route, or
  • The child of a BN(O) Status Holder applying on the BN(O) Household Member route, or
  • The partner of a child of a BN(O) Status Holder applying on the BN(O) Household Member route.

If the applicant is a parent or grandparent of a BN(O) Status Holder or their partner, the applicant must not be in a subsisting relationship with a partner unless:

1-That partner is also the parent or grandparent of the BN(O) Status Holder or their partner, or of the child of a BN(O) Status Holder on the BN(O) Household Member route, or the partner of a child of a BN(O) Status Holder on the BN(O) Household Member route.

2- That partner is applying for entry clearance or permission to stay simultaneously with the applicant.

Dependency Requirement

Applicants must meet the following conditions:

  • Due to age, illness, or disability, they require long-term personal care for daily activities.
  • They must be part of the same household as the BN(O) Status Holder or BN(O) Household Member who has or is concurrently being granted permission.
  • They cannot obtain the required level of care in Hong Kong, even with the practical and financial support of the BN(O) Status Holder, their partner, or the BN(O) Household Member or their partner, if these individuals move to the UK. This could be due to the unavailability or unaffordability of care in Hong Kong.

If the applicant and their partner are the parents or grandparents of the BN(O) Status Holder or their partner, or of the BN(O) Household Member or their partner, they must demonstrate:

1-A need for long-term personal care due to age, illness, or disability.

2-An inability to obtain the necessary care in Hong Kong if the BN(O) Status Holder, their partner, the BN(O) Household Member, or their partner relocates to the UK, either because the care is unavailable or unaffordable.

Suitability Requirements

The applicant must meet the standards outlined in Part 9 of the Immigration Rules, which detail the grounds for refusal.

Tuberculosis Test Requirement

If you're applying for entry clearance as a BN(O) Adult Dependent Relative under the Hong Kong British National (Overseas) route, and paragraph A39 along with Appendix T of the Immigration Rules apply, you must provide a valid medical certificate. This certificate must confirm that you have been screened for active pulmonary tuberculosis and that you are free from the disease.

Ordinary Residence Requirement

Applicants seeking entry clearance as a BN(O) Adult Dependent Relative must be ordinarily resident in Hong Kong at the time of application.

Financial Requirement for BN(O) Adult Dependent Relative Visa

If you're applying for entry clearance or seeking to extend your stay and have been in the UK for less than 12 months, or if your previous leave was granted under special circumstances outside the standard rules, the decision-maker must ensure that the BN(O) Status Holder, their partner, or the BN(O) Household Member (or their partner) can and will support and accommodate you without relying on public funds for at least six months. Accommodation is considered inadequate if:

1- It is overcrowded or 2- It violates public health regulations. The BN(O) Status Holder or their partner, or the BN(O) Household Member or their partner, may use credible future third-party support to meet these financial requirements. They must also demonstrate that they have the necessary funds as specified in Appendix Finance.

Period and Conditions of Grant for BN(O) Adult Dependent Relative Visa

If the applicant does not already hold permission under the Hong Kong British National (Overseas) route at the time of application, they will be granted permission to stay that ends on the same date as the BN(O) Status Holder or BN(O) Household Member who is part of the same household, depending on the application circumstances.

  • No access to public funds.
  • Permission to work (including self-employment and voluntary work) is granted, except in roles as a professional sportsperson or sports coach.
  • Permission to study is granted, subject to the conditions outlined in Appendix ATAS.
