Upon a successful application, the BN(O) dependent visa is granted for the same duration as the
sponsoring BN(O) status holder’s visa.

Requirements for BN(O) Dependent Visa Entry Clearance
Valid Entry Clearance Application
Applicants must submit a valid entry clearance application from outside the UK, following the guidelines
set forth in Appendix Hong Kong British National (Overseas) of the Immigration Rules.
Visa or Application Status of the Sponsoring BN(O)
When applying as a partner under the BN(O) Status Holder route, the applicant must be the partner of a
BN(O) status holder who:
1- Has made a valid application for entry clearance or permission to stay in the UK as a BN(O)
Status Holder that is yet to be decided, or
2- Already has entry clearance or permission as a BN(O) status holder.
For applicants applying as a BN(O) Household Child under the BN(O) Status Holder route, they must be
the child or grandchild of a BN(O) status holder or their partner who:
3- Has made a valid application for entry clearance or permission to stay in the UK as a BN(O)
status holder or as the partner of a BN(O) Status Holder, which has not yet been decided, or
4- Already has entry clearance or permission as a BN(O) status holder or as the partner of a BN(O)
status holder.
Applicants must not be subject to refusal under Part 9 of the Immigration Rules, which detail the
grounds for refusal.
Tuberculosis Test Certificate Requirement
For those applying for entry clearance under the BN(O) Status Holder route, if paragraph A39 and
Appendix T of the Immigration Rules apply, a valid medical certificate must be provided. This certificate
should confirm that the applicant has undergone screening for active pulmonary tuberculosis and is free
from the disease.
Applicants applying for entry clearance or permission to stay, who have not previously held permission
as a partner under the BN(O) Status Holder route, must meet specific relationship criteria outlined in HK
13.3 to HK 13.7.
The applicant must be the partner of the sponsoring BN(O) status holder where one of the following
applies:
1- The sponsoring BN(O) status holder has permission under the Hong Kong BN(O) route, or
2- The sponsoring BN(O) status holder is simultaneously applying for (and is granted) entry
clearance or permission under the Hong Kong BN(O) route.
The applicant must be 18 years or older at the date of application.
If the applicant and the BN(O) status holder are not married or in a civil partnership, the following
requirements must be met:
1- They must have lived together in a relationship akin to marriage or civil partnership for at least
two years before the application date.
2- Any prior relationship of the applicant or the BN(O) status holder with another person must
have permanently ended.
3- They must not be closely related to the extent that they would be prohibited from marrying in
the UK.
The relationship between the applicant and the BN(O) status holder must be genuine and ongoing. Both
must intend to live together throughout the applicant’s stay in the UK.
The applicant must be:
1- The child of a parent who has, or is concurrently granted, entry clearance or permission as a
BN(O) status holder or as the partner of a BN(O) status holder, or
2- The grandchild of a grandparent who has, or is concurrently granted, entry clearance or
permission as a BN(O) status holder or as the partner of a BN(O) status holder.
If applying as the grandchild of a grandparent with BN(O) status or permission, and the applicant has not
previously been granted permission as a BN(O) Household Child under the BN(O) Status Holder route,
they must:
3- Submit the application simultaneously with the grandparent who is applying for entry clearance
or permission under the BN(O) Status Holder route, and
4- Be part of the same household as the BN(O) status holder at the time of application.
Each of the applicant’s parents must either be applying simultaneously with the applicant or have
permission to be in the UK (excluding as a Visitor), unless:
5- The parent with BN(O) status or permission to stay as a BN(O) Status Holder or their partner is
the sole surviving parent, or
6- The parent with BN(O) status or permission to stay as a BN(O) Status Holder or their partner has
sole responsibility for the applicant’s upbringing, or
7- The parent without BN(O) status or permission as a BN(O) Status Holder or their partner:
o Is a British citizen or has the right to enter or stay in the UK without restriction, and
o Is or will be ordinarily resident in the UK, or
8- There are serious and compelling reasons to grant the applicant entry clearance or permission
to stay with the parent who has permission under the Hong Kong BN(O) route, or
For a child applying as a dependent, they must be under 18 years of age at the time of application. The
child must plan to live with a parent who holds permission under the BN(O) status holder route during
their stay in the UK unless there is a legitimate reason why they should not reside with that parent.
Suitable arrangements for the child’s care and accommodation in the UK must be in place, complying
with all relevant UK laws and regulations.
Ordinary Residence Requirement
Applicants seeking entry clearance as a dependent partner or BN(O) Household Child must be ordinarily
resident in Hong Kong at the time of application.
Financial Requirements for BN(O) Dependent Visa
When applying for entry clearance, it must be demonstrated that the applicant or the BN(O) status
holder can adequately maintain and accommodate the applicant in the UK without relying on public
funds for at least six months. For the purposes of HK 14.2, accommodation will not be considered
adequate if it is overcrowded or fails to meet public health regulations. The applicant or the BN(O)
status holder may also rely on credible third-party support promises. Evidence of sufficient funds, as
specified in Appendix Finance, must be provided.
If a partner applying for entry clearance does not already have permission under the BN(O) Status
Holder route, their visa will be granted for the same period as the BN(O) Status Holder. If the partner
already holds permission under the Hong Kong BN(O) route, they will be granted permission for either:
1- 30 months, if that was the duration requested, or
2- 5 years, if that was the requested duration.
For a BN(O) Household Child without prior permission under the BN(O) Status Holder route, their visa
will also match the expiration date of the BN(O) Status Holder’s permission. The visa grant will include
the following conditions:
3- No access to public funds,
4- Permission to work (including self-employment and voluntary work) except for roles as a
professional sportsperson or sports coach,
5- Permission to study, subject to the Academic Technology Approval Scheme (ATAS) conditions in
Appendix ATAS.
