Eligibility Criteria for Entry Clearance as a Health and Care Worker Dependent
To qualify for the Health and Care Worker dependent visa, you must meet the following requirements:
1- Provide documentation proving your relationship with the Health and Care Worker.
2- Show evidence of suitable accommodation in the UK that does not require public funds.
3- Demonstrate sufficient financial resources to support yourself without public assistance.
4- Submit a Tuberculosis test certificate if required under the Immigration Rules Appendix T.
5- If applicable, provide a criminal record certificate from any country where you have lived for 12
months or more in the past 10 years, starting from age 18.
To apply as a dependent partner, you must be in a relationship with the sponsoring Health and Care
Worker who:
1- Holds a Health and Care Worker visa; or
2- Is applying for and will be granted entry clearance under the Health and Care Worker route; or
3- Has settled status or British citizenship, having previously held a Health and Care Worker visa
when they settled, and you were their partner at that time.
If you are not married or in a civil partnership, you must:
4- Have lived together in a relationship akin to marriage or civil partnership for at least two years
before applying.
5- Ensure that any previous relationships have ended permanently.
6- Not be closely related to each other to a degree that would prevent you from marrying or
forming a civil partnership in the UK.
Your relationship must be genuine and ongoing, and you both must intend to live together throughout
your stay in the UK.
To qualify as a dependent child, you must be the child of the sponsoring Health and Care Worker who:
1- Holds a Health and Care Worker visa; or
2- Is applying for and will be granted entry clearance or permission under the Health and Care
Worker route; or
3- Has settled status or British citizenship, having previously held a Health and Care Worker visa
when they settled, and you were their dependent child at that time.
Both parents must be applying simultaneously or already have permission to remain in the UK (except as
a visitor), unless:
4- The parent applying as a Health and Care Worker is the sole surviving parent;
5- The applying parent has sole responsibility for your upbringing;
6- The other parent is a British citizen or has unrestricted rights to enter or remain in the UK and is
ordinarily resident there; or
7- There are serious and compelling reasons to allow you to join the parent applying under the
Health and Care Worker route.
When a Health and Care Worker is sponsored for a role listed under occupation codes in SW 16.1 of Appendix Health and Care Occupations, any partner applying for entry clearance must submit a criminal record certificate. This certificate must be obtained from the relevant authorities in any country where the applicant has lived for a total of 12 months or more within the last 10 years, provided they were 18 or older during that time. If the applicant cannot reasonably obtain a criminal record certificate, they must provide a satisfactory explanation for why it is not feasible.
Health and Care Workers and their dependents are required to demonstrate that they have sufficient funds to support themselves while in the UK. The amounts necessary for maintaining themselves are outlined by the Home Office UKVI Immigration Rules and are as follows:
Dependent Applicant | Funds Required |
---|---|
Partner of the Health and Care Worker | £285 |
One child of the Health and Care Worker | £315 |
Each additional child of the Health and Care Worker | £200 |
A dependent partner of a Health and Care Worker will receive permission that expires on the same date
as the Health and Care Worker’s visa, or a three-year visa if the Health and Care Worker has been
granted settlement. A dependent child will receive permission that ends on the earliest expiration date
of either parent’s visa, unless both parents have settled or become British citizens, in which case the
child will be granted three years of permission.
The visa is granted with the following conditions:
1- No access to public funds.
2- Permission to work (including self-employment and voluntary work) except as a professional
sportsperson or coach.
3- Permission to study, subject to the ATAS condition in Appendix ATAS if the applicant is over 18.
4- Requirement to register with the police, if applicable under Part 10 of the Immigration Rules.
