Who Qualifies as a Dependent of an HPI Migrant?
Eligible dependents include:
1- The spouse or civil partner of an HPI migrant;
2- An unmarried or same-sex partner of an HPI migrant;
3- A child under the age of 18 of an HPI migrant.
To qualify for entry clearance as a dependent of an HPI migrant, the following requirements must be
met:
Valid Application
Applications must be submitted from outside the UK and comply with the conditions set out in Appendix
High Potential Individual of the Immigration Rules.
Age Requirement for Partners
The applicant must be at least 18 years old at the time of the application.
Suitability Criteria
Applicants must not fall under any grounds for refusal outlined in Part 9 of the Immigration Rules.
Tuberculosis Screening
If applicable under paragraph A39 and Appendix T of the Immigration Rules, the applicant must provide
a valid medical certificate showing they have been screened for active pulmonary tuberculosis and are
clear.
Applicants must demonstrate their relationship with the HPI sponsor under one of the following
conditions:
1- The sponsor holds a valid HPI visa; or
2- The sponsor is applying for, and has been granted, entry clearance under the HPI route
simultaneously with the applicant.
For unmarried or non-civil partnership couples, additional criteria must be met:
3- The couple must have lived together in a relationship akin to marriage or civil partnership for at
least two years prior to the application.
4- Any previous relationships must have ended permanently.
5- The couple must not be so closely related that they would be prohibited from marrying or
forming a civil partnership in the UK.
The relationship must be genuine and ongoing, with both parties intending to live together in the UK.
Relationship Requirements for Dependent Children
The applicant must be the child of an HPI visa holder, under the following conditions:
1- The HPI sponsor holds valid permission under the HPI route; or
2- The sponsor is applying for, and has been granted, entry clearance or permission under the HPI
route at the same time as the child.
Both parents must either be applying alongside the child or already have permission to remain in the
UK, unless:
3- One parent is deceased, leaving the other as the sole surviving parent;
4- One parent has sole responsibility for the child’s upbringing;
5- The other parent, who does not hold an HPI visa, is a British citizen or has the right to reside in
the UK without restrictions and is ordinarily resident in the UK; or
6- There are compelling reasons, as determined by the decision maker, to grant the child entry
clearance or permission to remain with the HPI parent.
This ensures that the child’s best interests are considered in the application process.
When applying for a visa as a dependent child, the applicant must be under 18 years old at the time of application unless they were previously granted permission as the dependent child of their parent(s). For applicants aged 16 or older, it is required that they are not living independently. If the child is under 18, suitable care and accommodation arrangements must be in place in the UK, adhering to the relevant UK laws and regulations.
To support themselves while in the UK, High Potential Individuals (HPI) and their dependents must have
a specific amount of money available. According to UKVI Immigration Rules, the required maintenance
funds for an HPI dependent visa are as follows:
Dependent Applicant | Funds Required |
---|---|
Partner of the High Potential Individual (HPI) | £285 |
One child of the High Potential Individual (HPI) | £315 |
Each additional child of the High Potential Individual (HPI) | £200 |
1- Partners: The visa for a partner of a High Potential Individual (HPI) will expire on the same date
as the main applicant’s HPI visa.
2- Children: A dependent child’s visa will expire on the same date as the parent whose visa ends
first.
The HPI dependent visa will come with the following conditions:
3- No access to public funds.
4- Employment and self-employment are permitted, except in professional sports roles (including
coaching).
5- Study is allowed, with the ATAS condition in Appendix ATAS applicable if the applicant is over 18
years old.
