Eligibility Requirements for Limited Leave to Enter as an Adopted Child
As per paragraph 314 of the Immigration Rules, the following conditions must be met for a child to be
granted limited leave to enter the UK with the intent to settle as the adopted child of a parent or
parents who have been granted limited leave to enter or remain in the UK:
Parental Circumstances: The child must be seeking entry to accompany or join a parent or
parents under one of the following conditions:
o One parent is already present and settled in the UK or is being admitted for settlement
at the same time as the child, while the other parent has been or is being granted
limited leave to enter or remain in the UK with the intention of settling.
o One parent has been or is being granted limited leave to enter or remain in the UK with
the intention of settling and has had sole responsibility for the child's upbringing.
o One parent has been or is being granted limited leave to enter or remain in the UK with
the intention of settling, and there are serious and compelling family or other
considerations making the child's exclusion undesirable, with suitable arrangements
made for the child's care.
o In cases of de facto adoption, one parent has the right of abode in the UK or indefinite
leave to enter or remain and is seeking admission to the UK for settlement at the same
time as the child.
Age Requirement: The child must be under the age of 18.
Dependency Status: The child must not be leading an independent life, must be unmarried, not
in a civil partnership, and must not have formed an independent family unit.
Financial and Accommodation Conditions: The child must be able to be accommodated and
maintained without recourse to public funds, in a property that is owned or occupied exclusively
by the adoptive parent(s).
Adoption Recognition: The child must have been adopted following a decision by the
competent authority or court in their country of origin or residence, with the adoption order
recognized by the UK. Alternatively, the child must be the subject of a de facto adoption.
Adoption Circumstances: The adoption must have occurred when:
o Both adoptive parents were living together abroad, or
o One or both adoptive parents were settled in the UK.
Rights and Responsibilities: The child should have the same rights and obligations as any other
child in the adoptive family.
Genuine Transfer of Parental Responsibility: The adoption must have taken place due to the
original parents' or current carers' inability to care for the child, with a genuine transfer of
parental responsibility to the adoptive parents.
Severance of Ties: The child must have lost or severed ties with their family of origin.
No Convenience Adoption: The adoption must not have been arranged solely for the purpose of
facilitating the child's entry into the UK.
