Who Can Apply as a Dependent of a Scale-up Worker?
You may apply as a dependent if you are:
1- The spouse, civil partner, or unmarried/same-sex partner of a Scale-up Worker
2- A child under 18 years old of a Scale-up Worker
Eligibility Requirements for Entry Clearance as a Dependent of a Scale-up Worker
To qualify for entry clearance as a dependent of a Scale-up Worker, you must meet the following
criteria:
1- Valid Application: The application must be submitted from outside the UK.
2- Relationship Requirement: The relationship between the applicant and the Scale-up Worker
must meet the conditions outlined in Appendix Scale-up Worker.
3- Age Requirement for Partner: If applying as a dependent partner, you must be 18 years or older
at the time of application.
4- Age and Care Requirement for Child: If applying as a dependent child, you must be under 18
years old at the time of application unless you were last granted permission as a dependent
child. Appropriate arrangements for care and accommodation in the UK must be in place.
5- Suitability Requirement: The applicant must not be subject to refusal under Part 9: grounds for
refusal.
6- Financial Requirement: The applicant must satisfy the financial criteria as per Appendix Scale-up
Worker of the Immigration Rules.
7- Tuberculosis Test Certificate: If applicable, a valid medical certificate showing that you have
been screened for active pulmonary tuberculosis must be provided.
To qualify as a dependent partner, you must be in a genuine and subsisting relationship with the Scale-
up Worker who either:
1- Already holds a Scale-up Worker visa, or
2- Is applying for and will be granted entry clearance on the Scale-up Worker route at the same
time.
If you are not married or in a civil partnership with the Scale-up Worker, you must meet the following
additional criteria:
3- You must have lived together in a relationship akin to marriage or civil partnership for at least
two years before applying.
4- Any previous relationship of either partner must have permanently ended.
5- You must not be closely related in a way that would prevent you from marrying or forming a civil
partnership in the UK.
You and your Scale-up Worker partner must intend to live together throughout your stay in the UK.
To qualify as a dependent child, you must be the child of the Scale-up Worker who either:
1- Holds a Scale-up Worker visa, or
2- Is applying for and will be granted entry clearance or permission on the Scale-up Worker route
at the same time.
Both parents must either be applying at the same time as the child or already have permission to stay in
the UK (other than as a Visitor), unless:
1- The parent applying for or holding a Scale-up Worker visa is the sole surviving parent,
2- That parent has sole responsibility for the child’s upbringing, or
3- The other parent is a British citizen, has the right to enter or stay in the UK without restriction,
and is or will be ordinarily resident in the UK.
The decision-maker may also grant the child entry clearance if there are serious and compelling reasons
to do so in cases that do not meet the above criteria.
A child applying as a dependent must be under 18 years old at the time of application unless they were previously granted permission as a dependent. If the child is 16 years or older at the time of application, they must not be living independently. For children under 18, appropriate arrangements for their care and accommodation in the UK must be in place, ensuring compliance with UK laws and regulations.
The Scale-up Worker or their dependents must demonstrate that they have sufficient financial resources
to support themselves during their stay in the UK. According to the Home Office UKVI Immigration
Rules, the required funds for a Scale-up Worker dependent visa are as follows:

1- The dependent partner of a Scale-up Worker will be granted leave to stay in the UK, ending on
the same date as the Scale-up Worker’s visa.
2- A dependent child will be granted leave to stay in the UK, which expires on the same date as the
visa of whichever parent’s permission ends first.
The Scale-up Worker dependent visa comes with the following conditions:
3- No access to public funds.
4- Employment (including self-employment and voluntary work) is allowed, except as a
professional sportsperson (including as a sports coach).
5- Study is permitted, subject to the ATAS condition in Appendix ATAS, if the applicant is over 18
years old.
