Who Can Apply as a Dependent of a UK Ancestry Visa Holder?
A UK Ancestry dependent visa may be applied for by:
1- The husband, wife, or civil partner of the UK Ancestry visa holder.
2- The unmarried or same-sex partner of the UK Ancestry visa holder.
3- A child under 18 years of age of the UK Ancestry visa holder.
Eligibility Criteria for UK Ancestry Dependent Visa Entry Clearance
To qualify for a UK Ancestry dependent visa, you must meet the following requirements:
1- Valid Application: A complete and valid entry clearance application must be submitted.
2- Status of the UK Ancestry Visa Holder: The applicant must be the partner or child of someone
who:
o Has submitted a valid application for entry clearance or leave to remain under the UK
Ancestry route that is pending a decision, or
o Has already been granted entry clearance or leave to remain under the UK Ancestry
route.
3- Suitability: The applicant must meet the suitability criteria, which include not being subject to
refusal under Part 9 of the Immigration Rules.
4- Relationship: The relationship between the applicant and the UK Ancestry visa holder must
satisfy the conditions outlined in Appendix UK Ancestry.
5- Age and Care for Children: If the applicant is a child, they must be under 18, and appropriate
care arrangements must be in place.
6- Financial Requirements: The applicant must demonstrate that there will be sufficient funds and
suitable accommodation available for them, the UK Ancestry visa holder, and any other
dependents in the UK, without relying on public funds. Financial evidence must meet the
standards set out in Appendix Finance.
7- Tuberculosis Test: A valid Tuberculosis test certificate must be provided if required under
Appendix T of the Immigration Rules.
To apply as a partner under the UK Ancestry route, the following conditions must be met:
1- Status of UK Ancestry Visa Holder: The UK Ancestry visa holder must either already have leave
to remain or be applying for (and be granted) leave to enter or remain under the UK Ancestry
route at the same time as the dependent.
2- Unmarried Partners: If the applicant and the UK Ancestry visa holder are not married or in a civil
partnership, they must have been living together in a relationship akin to marriage or civil
partnership for at least two years before the application date. Additionally, any previous
relationships involving either party must have permanently ended, and the couple must not be
closely related in a way that would prohibit marriage or civil partnership in the UK.
3- Genuine Relationship: The relationship between the applicant and the UK Ancestry visa holder
must be genuine and ongoing.
4- Intent to Cohabit: Both the applicant and the UK Ancestry visa holder must intend to live
together throughout the applicant’s stay in the UK.
To qualify as a dependent child under the UK Ancestry route, the child must be related to the sponsoring
UK Ancestry visa holder. The following conditions must be met:
1- The UK Ancestry visa holder already has permission to stay in the UK under this route, or
2- The UK Ancestry visa holder is applying for, and is granted, permission to stay under this route
at the same time.
3- If the parent applying under the UK Ancestry route is the only surviving parent.
4- If the parent applying under the UK Ancestry route has sole responsibility for the child's
upbringing.
5- If the non-applying parent is a British citizen or has the right to live in the UK without restriction
and is or will be ordinarily resident in the UK.
6- If the decision-maker is convinced that there are significant reasons to allow the child to join the
parent with UK Ancestry permission.
To qualify as a dependent child of a Skilled Worker visa holder, the applicant must be the child of a
Skilled Worker who either:
1- Holds a Skilled Worker visa.
2- Is applying for, and will be granted, entry clearance or permission under the Skilled Worker
route at the same time.
Both parents of the child must either be applying alongside the child or already have permission to be in
the UK (excluding as a Visitor), unless:
1- The parent applying or holding a Skilled Worker visa is the only surviving parent.
2- The parent applying or holding a Skilled Worker visa has sole responsibility for the child's
upbringing.
1- The other parent who is not a Skilled Worker:
o Is a British citizen or has the right to live in the UK without restrictions.
o Is, or will be, ordinarily resident in the UK.
3- The decision-maker finds compelling reasons to grant the child entry clearance or permission to
stay with the parent who is a Skilled Worker visa holder.
A dependent child must be under 18 years old at the time of application unless they were previously granted permission as a dependent child. If the child is 16 or older at the time of application, they must not be living independently. For applicants under 18, appropriate care and accommodation arrangements must be made in the UK, adhering to relevant UK laws and regulations.
For children under 18 at the time of application, proper care and accommodation must be arranged in compliance with UK laws and regulations.
The child must be under 18 years old at the time of application unless they were previously granted
permission as a dependent. If the child is 16 or older, they must not be living independently.
