with your overseas employer, you can apply for entry clearance for the Senior or
Specialist Worker visa. This process is commonly referred to as an intra-company transfer (ICT).
Applications for this visa must comply with the guidelines outlined in the Immigration Rules, specifically
under Appendix Global Business Mobility Routes.
The Global Business Mobility – Senior or Specialist Worker route does not provide a direct path to
settlement in the UK, meaning it doesn't lead to Indefinite Leave to Remain (ILR). However, it's possible
to switch from the Senior or Specialist Worker visa to other work visa categories that do lead to ILR, such
as the Skilled Worker visa, while remaining in the UK.
Our team of experienced immigration solicitors in London is available to offer expert advice and
representation on a fixed-fee basis for your Senior or Specialist Worker visa entry clearance application.
You can seek free immigration advice from our work visa solicitors online or schedule an appointment
for a comprehensive consultation regarding your application for entry clearance from outside the UK.
Requirements for Entry Clearance for the Senior or Specialist Worker Visa
To be eligible for entry clearance under the Senior or Specialist Worker category, applicants must satisfy
the following criteria:
Valid Entry Clearance Application
Applicants must submit a valid entry clearance application for the Senior or Specialist Worker visa as per
the rules.
Valid Certificate of Sponsorship (CoS)
Applicants must have a Certificate of Sponsorship issued by their sponsor within three months before
the application date.
Age Requirement
Applicants must be at least 18 years old at the time of application.
Suitability Requirements
Applicants must not fall under the grounds for refusal specified in Part 9 of the Immigration Rules.
Tuberculosis Test Certificate
If applicable, applicants must provide a valid medical certificate confirming they are free from active
pulmonary tuberculosis as per paragraph A39 and Appendix T of the rules.
To be awarded points for sponsorship, applicants must hold a valid Certificate of Sponsorship (CoS)
confirming:
1- The applicant’s name, sponsorship as a Senior or Specialist Worker, job details, salary, and any
applicable allowances, as well as PAYE details if required by HM Revenue and Customs (HMRC).
2- A job start date within three months of the application date.
3- The CoS has not been used in a previous granted or refused application (unless it was rejected
as invalid, voided, or withdrawn).
4- The CoS has not been withdrawn by the sponsor or canceled by the Home Office.
5- If the applicant is not a high earner, confirmation that they have worked outside the UK for the
sponsor group for the required period as per SNR 5.7.(b).
6- Whether the Academic Technology Approval Scheme (ATAS) applies.
The sponsor must be authorized by the Home Office to sponsor a Senior or Specialist Worker and should
be listed as A-rated on the Home Office’s register of licensed sponsors. Additionally, the sponsor must
have fully paid any required Immigration Skills Charge.
The decision-maker must not have reasonable grounds to believe that the job being sponsored is non-
existent, a sham, or created solely for the purpose of applying for entry clearance or permission to stay.
The applicant must:
7- Be currently employed by the sponsor group.
8- Unless they qualify as a high earner, have worked outside the UK for the sponsor group for a
cumulative period of at least 12 months.
Under SNR 5.7.(b) of Appendix Global Business Mobility Routes, the 12 months of work outside the UK
can be accumulated over any period, provided:
9- The applicant has been continuously working for the sponsor group from the start of the 12
months to the date of application.
10- Any breaks in continuous work were for reasons such as statutory maternity, paternity,
parental, or shared parental leave; statutory adoption leave; sick leave; participation in
humanitarian or environmental crises with sponsor group approval; or legally organized
industrial action.
Meeting these requirements will award the applicant 20 points for sponsorship.
To qualify for this visa, the applicant must be sponsored for a role within an occupation code listed in
Appendix Skilled Occupations, deemed eligible for the Global Business Mobility routes. However, this
requirement is waived if the conditions in SNR 6.7 of Appendix Global Business Mobility Routes are
satisfied.
The sponsor must select an appropriate occupation code. The decision-maker must ensure that the
chosen code is suitable and not selected for less appropriate reasons, such as:
1- The most suitable occupation code is ineligible under the Global Business Mobility routes.
2- The most suitable occupation code has a higher going rate than the offered salary.
To assess this, the decision-maker may consider:
3- Whether the sponsor genuinely needs the job as described.
4- Whether the applicant has the necessary skills, qualifications, and experience.
5- The sponsor's history of compliance with immigration regulations, including paying sponsored
workers fairly.
6- Additional information provided by the sponsor.
If the Academic Technology Approval Scheme (ATAS) applies, the applicant must provide a valid ATAS
certificate. Meeting these requirements will award the applicant 20 points for having a job at the
appropriate skill level. However, no points will be given for skill level if the applicant does not also
receive 20 points for sponsorship under SNR 5.9.
The applicant's salary must meet or exceed both:
1- The general salary requirement outlined in SNR 8.1 and SNR 8.2, unless SNR 8.3 applies.
2- The going rate requirement specified in SNR 9.1 to SNR 9.3.
The salary considered under these requirements includes:
3- Guaranteed basic gross pay (before tax, including employee pension and national insurance
contributions).
4- Allowances guaranteed for the duration of UK employment, such as London weighting, mobility
premiums, or cost-of-living adjustments.
Allowances specifically for accommodation are considered only up to 30% of the total salary package.
The salary does not include:
5- Flexible pay, where hours fluctuate and income is not guaranteed.
6- Additional pay like shift, overtime, or bonuses, whether guaranteed or not.
7- Employer pension and national insurance contributions.
8- Any allowances not specified in SNR 7.2.(b).
9- In-kind benefits such as equity shares, health insurance, educational fees, company cars, or
meals.
10- One-time payments like "golden hellos.
11- Payments for immigration-related costs, such as fees or the Immigration Health Charge.
12- Business expense reimbursements, including travel, equipment, clothing, or subsistence.
Meeting these salary requirements will award the applicant 20 points, provided they also earn 20 points
for sponsorship under SNR 5.9.
If the applicant is sponsored for a job within an occupation code listed in Table 1 of Appendix Skilled
Occupations, the general salary requirement is £42,400 per year, unless SNR 8.3 conditions apply.
For applicants working more than 48 hours a week, only the first 48 hours' pay will be considered
towards the general salary requirement. For example, an applicant working 60 hours a week at £15 per
hour will be considered to have an annual salary of £37,440 (£15 x 48 x 52) instead of £46,800 (£15 x 60
x 52).
Going Rate Requirement for Senior or Specialist Worker
The going rate requirement is 100% of the pro-rated rate for the occupation code listed in Table 1 of
Appendix Skilled Occupations, calculated as follows:
1- 1 x (going rate for the occupation code) x (weekly working hours ÷ 39).
For jobs in health or education (Table 2 of Appendix Skilled Occupations), the going rate is also 100% of
the pro-rated rate, adjusted according to the sponsor's stated weekly working hours.
When assessing the salary against the going rate, the full weekly hours are considered, even if the
applicant works more than 48 hours a week. For example, a job with a going rate of £39,000 requiring
60 hours a week must pay £60,000 annually (1 x £39,000 x 60 ÷ 39), not £48,000 (1 x £39,000 x 48 ÷ 39).
For entry clearance, the applicant must:
1- Hold at least £1,270 in funds, maintained for 28 days as outlined in Appendix Finance, or
2- Have an A-rated sponsor who confirms on the Certificate of Sponsorship that they will cover the
applicant's maintenance and accommodation costs for up to £1,270 in the first month if
necessary.
Maximum Length of Assignment
For high earners, the total period granted on Global Business Mobility and Intra-Company routes must
not exceed 9 years within any 10-year period.
For non-high earners, the total period must not exceed 5 years within any 6-year period.
When calculating cumulative periods of permission, the following are included:
1- All previous periods granted on the Global Business Mobility routes.
2- All previous periods granted on the Intra-Company routes.
3- Any permission granted under the current application, starting from the job's start date on the
Certificate of Sponsorship.
4- Any permission granted under the current application for applicants applying to stay, beginning
from the decision date.
5- Any period extended under section 3C of the Immigration Act 1971.
