Eligible Family Members for Switching to the HPI Dependent Visa
The following family members of an HPI visa holder may be eligible to switch to a dependent visa:
Spouse or civil partner of the HPI visa holder.
Unmarried or same-sex partner of the HPI visa holder.
Child under 18 years old of the HPI visa holder.
Children over 18 may still qualify if they initially entered the UK on a dependent visa before turning 18.
Requirements for Switching to the HPI Dependent Visa
Valid Application:
The application for switching to the HPI Dependent visa must be submitted from within the UK, adhering
to the requirements laid out in Appendix High Potential Individual (HPI).
Immigration Status:
Applicants must not currently hold or have last held permission as:
A Visitor,
A Short-term Student,
A Parent of a Child Student,
A Seasonal Worker,
A Domestic Worker in a Private Household, or
Any category outside the Immigration Rules.
Suitability Requirements:
The applicant must not be subject to refusal under Part 9: grounds for refusal. Additionally, they must
not be in breach of immigration laws (with certain exceptions) or on immigration bail.
Relationship Requirement for a Dependent Partner:
The applicant must be the partner of the HPI visa holder, who must either:
Hold a valid HPI visa, or
Be applying for and granted entry clearance on the HPI route simultaneously.
Unmarried or same-sex partners must also demonstrate that:
They have lived together in a marriage-like relationship for at least two years,
Any previous relationships have permanently ended, and
They are not closely related to the extent that marriage or civil partnership in the UK would be
prohibited.
The relationship must be genuine and ongoing, with both parties intending to live together throughout
their stay in the UK.
Relationship Requirement for a Dependent Child:
The applicant must be the child of an HPI visa holder who either:
Has permission under the HPI route, or
Is simultaneously applying for and being granted entry clearance or permission under the HPI
route.
Both parents must either apply at the same time or already have permission to stay in the UK (other
than as a Visitor), unless:
One parent is deceased,
One parent has sole responsibility for the child, or
The other parent is a British citizen or otherwise has unrestricted rights to reside in the UK.
For children born in the UK to an HPI visa holder or their partner, a full UK birth certificate naming both
parents must be provided.
Age and Care Requirements for a Child:
Children must be under 18 at the time of application, unless they were previously granted permission as
a dependent. If 16 or older, they must not be living independently. Additionally, appropriate care and
accommodation arrangements must be in place in compliance with UK regulations.
A dependent partner of a High Potential Individual (HPI) who switches to an HPI Dependent visa will be
granted leave to remain that aligns with the end date of the HPI visa holder’s permission. Similarly, a
child of an HPI visa holder will receive leave to remain that ends on the earliest of their parents’ visa
expiry dates.
The visa grant will come with the following conditions:
No access to public funds.
Permission to work, including self-employment and voluntary work, is granted, but professional
sports-related activities (including coaching) are excluded.
Study is allowed, subject to the ATAS requirement in Appendix ATAS, for applicants aged 18 or
